British National Identity among Ethnic  Minorities Identity is something many of us don’t think about, but it is the main force behind our daily decisions. Britishness is defined as the state or quality of being British. This means that Britishness involves habits, behaviors, language, culture, and symbols that are common, recognizable, and iconic to the United Kingdom. Sometimes however, it is hard to define Britishness because it cannot be defined as one thing, like many identities, it evolves and transforms ever so often.British identity has been a subject of many debates since the 1960s, prompted initially by â€Å"the loss of empire, then by the rise of the welfare state, postwar black and Asian migration and entry into the European Community, and more recently by the devolution of power to Scotland and Wales† (Parekh, 1). â€Å"Some claim that the most challenging minority integration in contemporary society is immigrant-origin non-white communities† (Max well, 2), but this is becoming a false claim. The British national identity has been on a decline with more Britons claiming their identity as English, Scottish, Irish, or Welsh.This however, is not true for ethnic minorities in the UK. Headlines around many newspapers read â€Å"Ethnic minorities are now more likely to feel British than white people† There was a study done by the Institute for Public Policy Research that resulted in 51 percent of blacks and Asians describing themselves as British compared with just 29 per cent of whites. Data shows that in 1996, â€Å"52 percent of respondents to a poll said they saw themselves primarily as British. By 2005, this had fallen to just 44 per cent. The IPPR study said that Scottish and Welsh devolution had damaged British feeling† (Daily Mail).Professor Platt stated that â€Å"Given the current anxiety around immigration and concerns that it is challenging a unified national identity, it is interesting to find that minor ities in fact hold stronger British identities on average than the majority, we also see that they frequently manage dual identities, rather than opposing one to the other. Among the majority, individual country identities such as Scottish or Welsh can be held alongside a British identity, but in many cases seem to substitute for it† (CLS).Many believe that the desire for minorities to integrate into society is not enough to create a sense of belonging and ultimately the feeling of Britishness. â€Å"The desire to be integral to society has to be reciprocated too, in terms of the opportunity to belong to the national community, as well as in terms of socio-economic inclusion. So the long-term intergenerational decline in racism in British society is also an important and necessary condition for integration and patriotism† (Katwla, 1). Minorities in Great Britain are very active in British society.Katwla claims that â€Å"there is a strong pro-integration preference amo ng minorities – for civic and political participation, democracy and the rule of law, and most recognize the importance of the English language for social, economic and civic inclusion. † The acceptance about being British could also be because of the shared history between Britain and the immigrant’s home country. In places such as India and Africa, the empire was deeply rooted into their history. Katwla goes even further to say that â€Å"The issue is not just claiming a voice in helping to shape a common future.It is also about reminding ourselves that complicated and contested though it certainly was, we have shared more history than we think. You can look for and find British Muslim patriotism in reports from the First World War trenches, and not only in the last few years. † There is however, a negative side to this, as the ethnic minorities are claiming a British identity, many white Britons are claiming another. There is a growing fear that the ris e in English national identity is also a rise in hostility towards cultural diversity. So some express the fear that a return to the traditional â€Å"blood nations† will leave the ethnic minorities as the last Brits standing, rallying around a flag that indigenous Brits have deserted† (Katwala). There is a weaker sense of British national identity among white Britons. This presumed decline in Britishness can be seen as â€Å"resulting from one or both of two processes, on the one hand, the English appear to be becoming more â€Å"English† at the expense of being British. Secondly, the Scots are seen as becoming more Scottish.And a consequent decline in Britishness is assumed† (Bechhofer, 252). Devolution has contributed in the decline of a British national identity. â€Å"The largest marginal effect by a large distance is the effect of being born in Northern Ireland – this reduces the probability of reporting a British identity by 24%. It is almos t certain that this is driven primarily by Northern Irish Catholics among whom there remains a strong demand to be part of Ireland and not the UK and who think of themselves as Irish rather than British† (Manning, F79-F80).Many white Britons are not claiming a national identity and it seems that, for white Britons, the local identity is more important than the national identity. For minorities, it is easier to identity with the national identity because there are no negative connotations associated with it. The British identity allows for the foreigners to keep their home identity which they can maintain their ethnic identity. â€Å"British is a label that unites all peoples living in Britain today regardless of color, creed, and nationality† (Bechhofer , 256).Immigrants who become UK citizens are much more likely to report a British identity and the take-up ofcitizenship might be influenced by a number of factors. â€Å"First, there are a number of practical advantage s to citizenship – one has the right to work and vote in the UK and one can travel into the country without the need for a visa†¦ Apart from the practical advantages, there may be more emotional advantages to adopting a British identity. In particular we hypothesize that immigrants may be more likely to express a British identity if Britain compares favorably with the country from which they came† (Manning, F93).Minorities in Britain have also assimilated into the culture of being British. â€Å"There is a large amount of variation across country of birth in the fraction of immigrants reporting a British identity. For those from Slovakia it is less than 5%, for those from Malta more than 80%. But there is, for the most part, a simple explanation for these very large cross-country differences – the average amount of time spent in the UK† (Manning, F84). It seems that the longer the person stays in the country, the more they will think of themselves as British, Britishness just seems to grow on people. Benedict Anderson defines the nation as ‘an imagined community’ that is territorially limited and united by a ‘deep, horizontal, comradeship’ between its members. Adam Luedtke defines social identity ‘an affective (emotional) state of belonging in a social group†¦that stems from extended socialization, and is not easily changed. A ‘national identity’, therefore, is the emotional state of belonging felt by citizens towards, and within, the ‘imagined community’ of their nation† ( Kerr, 1).Over the decades there has been an overall decline in the proportion of people who define themselves as British and nationally characterize themselves as Britons. On average, a higher proportion of non-white ethnic minorities tend to call their selves British and relate to the British national identity. In conclusion, assimilation into the British culture has brought about a strong identity for ethnic minorities. The opposite is true for the white British population.On average there has been a decline in claiming the British national identity and this decline can be pointed to devolution taking place around the United Kingdom. Leadership Management Essay

Introduction In this report, a research regarding leadership was conducted through observation and interviewing of an effective leader. The leader that was chosen for this research report is Tan Kee Boon Valdric. Valdric was a commissioned officer in the Singapore Armed Forces (SAF). Singapore Armed Forces is a military organisation and its main purpose is to protect Singapore from any form of external threats. Upon commission, he was assigned to be the platoon commander for my platoon during national service in the 40th Singapore Armour Regiment (40SAR) and later on in our reservist unit at 473 Singapore Armour Regiment (473 SAR). By observing and interviewing him, the observation and interview results were compared with each other to see if there was any coherence in the results. These results were later compared in the reflection portion of this report to identify the complexities of leadership, the new understanding that was gained from this research and how undertaking this research and gaining new understanding of leadership would benefit my leadership abilities. Observation during National Service and Reservist As a platoon commander, Valdric would often plan and conduct many activities, exercises and trainings in camps. While planning for such activities, he would have to assign tasks to various personnel to complete the different tasks required of such activities. For instance, when conducting an Individual Physical Proficiency Test (IPPT), he would have to assign personnel to do various tasks required for the activity to proceed smoothly. When conducting such routine test activities in camp, he would often just assign tasks to soldiers in the platoon without further explanation as most of the people in the platoon are experienced and competent in doing the tasks. However, when assigning tasks to the newer inexperienced soldiers in the platoon, he would often give advices and guide them. For instance, when he was assigning tasks to the new batch of inexperienced sergeants who had just completed their training course, he would follow them and guide them accordingly on how to go about completing their tasks and encourage them. This changing leadership style based on the level of experience of personnel under him can be seen as a form of situational leadership II. Situational Leadership II is a model of contingency leadership in which leaders select different leadership based on their behaviour and the level of competency and capability of group members whom they are leading (Dubrin 2011). According to Blanchard (2010), situational leadership II model has four leadership styles which are namely directing, coaching, supporting and delegating which effective leaders adopt based on matching the level of competence of their group members. In Valdric’s case, when assigning tasks to the new inexperienced sergeants, he could be seen as choosing to exhibit a coaching leadership style which requires more supportive and directive behaviours and while assigning tasks to experienced personnel, he would exhibit a delegating leadership style which requires a less supportive and directive behaviour of the leader. Based on this observation, it could be seen that Valdric applies the Situational Leadership II model to alter his leadership style based on the level of competence and experience of his personnel. When problems or difficulty arises during activities or duties, Valdric would always keep calm and be open to suggestion for ideas and would accept any idea that sounds feasible in handling the problems or difficulties that arises. By keeping his composure and accepting feasible ideas suggested by those in the platoon, it can be seen as having self-confidence and flexibility which are some of the personality traits of an effective leader (Lussier & Achua 2009). On a few occasions, difficulties such as a sudden vehicle breakdown occurred during training. Instead of panicking, he kept his composure and called the sergeants and commanders together to discuss what they should do. Valdric would often decide upon a solution through participative discussion and consultation of personnel that are of lower ranking, usually the sergeants, in the platoon. During the planning of training programmes, which was something he had to do monthly, he would always discuss with the other commanders, the sergeants, in the platoon and decide on what training programmes they should include for the upcoming month. Participative leadership style in decision making is a style in which the leader would discuss and consult with members of a lower rank in the group before making a decision (Barman 2009). It can be seen that Valdric exhibits this participative leadership style through his use of participative discussion and consultation in planning training programmes. Valdric was always planning and thinking of ways to improve the platoon’s efficiency in terms of expertise skill levels and physical fitness which are crucial attributes required of soldiers in the Singapore Armed Forces (SAF). He would always plan new goals and visions to constantly improve the platoon’s expertise skill level and fitness and then communicate and inspire the platoon about the importance of constant. This constant seeking of improvement through creating new goals and visions to improve the platoon and efficiency of the military organisation could be seen as exhibiting a socialized charismatic leadership style. Socialized charismatic leaders are leaders who would use their influential powers to try and motivate groups and people in the organisation to improve organisation effectiveness and efficiency (Gardner, Avolio and Walumbwa 2005). Valdric’s desire to constantly improve the skill level of the platoon in order to help improve the progress and efficiency of the SAF is similar to a socialized charismatic leadership style. Interview Results An interview was conducted to find out more about how Valdric felt about his leadership characteristics and what he thinks are some of the leadership characteristics required to be an effective leader. Through the interview, a better understanding of his leadership characteristics and experiences was captured. From the interview, Valdric felt that some personality traits like self-confidence, trustworthiness and flexibility were key personality traits required to be an effective leader. He believed that self-confidence was required as he felt that leaders should have a certain level of confidence in order to lead. The second trait that he believed was a pre-requisite for effective leaders was trustworthiness as he felt that effective leaders need to build trust between his followers and himself in order to effectively lead them. Flexibility was another personality trait that he felt was important as he believed that leaders should be flexible so that they can change their leadership styles depending on the different environment and situation they are required to work in. Based on the interview results regarding personality traits, it can be seen that personality traits of self-confidence and flexibility are consistent of what with the observations results in which personality traits of self-confidence and flexibility was observed in Valdric. Another finding obtained from the interview session with Valdric was that he would change his leadership style based on the level of experience and expertise of the group members that he led. Valdric believed that group members who are inexperienced and lacking in skill required more nurturing and support from leaders and in such situations, leaders should give more specific instructions and support to help group members to gain experience and learn the skills required for the job efficiently. When questioned about another scenario in which he was leading a group which consists of experienced and skilled members, Valdric mentioned that he would switch to a less directive leading style in which he would be less specific in terms of giving instructions but he would continue to support his group members in terms of motivating them and encouraging them to keep the morale level within the group high. This finding is coherent with the observations results regarding how Valdric manages and assigns tasks to personnel in the platoon based on their level of experience. Based on the observation and interview results, it can be seen that Valdric uses the contingency approach to leadership to lead effectively. The alteration of leadership style based on the level of experience of the group they are leading is based on the situational leadership II model (Hellriegel and Slocum 2007). Valdric also felt that leaders should have different leadership styles and the ability to match the correct leadership style to the correct situation. He felt that given a situation, if the leader chooses the incorrect style to lead, it would wane the effectiveness of situational leadership. Another important role for leaders is decision-making for the group or organization. Valdric felt that decisions made by leaders would affect the effectiveness of the group or organisation which they are leading. In his opinion, the decision made by the leader should be a decision which is agreed upon by majority of the individuals in the group or organisation. To achieve this, Valdric mentioned that he often call for meetings with group members to discuss about issues and problems before he makes a decision. This was coherent with the observations results. Both the observation and interview results converge to show that Valdric uses group participation in decision-making. The use of such meetings to discuss ideas and suggestions before the leader makes a decision can be seen as a form of participative leadership style in decision-making. A leader exhibiting participative style involves his group members in the decision-making process by allowing group members to voice their opinions before the leader himself makes the final decision (Saxena 2009). However, Valdric mentioned that there are some disadvantages in the use of participative leadership styles during decision-making. In situations when there are a wide range of differing opinions in the group, it can be extremely difficult to obtain a consensus on a decision that is accepted by everyone in the group. Furthermore, he also mentioned that in situations when a decision needs to be made quickly, this leadership style would not be as effective as it tends to consume too much time before the leader makes a decision. Reflection and Improvement From this assignment, I have learnt about the various complexities of leadership through analysing and reflecting on the observation and interview results. From analysing the observation and interview results a comparison can be made between my findings regarding the complexities of various leadership styles and the theories taught in this leadership and management course. Based on my observation and interview results regarding participative leadership style, I learnt that although leaders exhibiting this style allows group members to have a feel of participation in the decision-making process and creates a sense of belonging to the group which further drives them to work harder for the leader, this style may become ineffective when there are various differences in opinion and it is often too time consuming. This is coherent with the theories regarding the complexities of democratic leadership style or participative leadership style. One of the common problem that leaders exhibiting participative leadership style during decision making was that such the use of such group meeting requires too much time (eds Muenjohn, Boucher & Tran 2010). This shows that what I have learnt and understand through the conducting of this research is coherent with the theories that I have learnt in this leadership and management course. Another similarity in finding which I have made from this research that is coherent with leadership theories is regarding the situational leadership II model in which leaders selects an appropriate style of leadership based on the level of experience of the members in the group which they are leading. From the observation and interview results, I have learnt that in order for situational leadership to be effective, a leader has to be flexible enough to change his leadership style to correctly match the situation. If a leader is not able to match his leadership style to the situation effectively, the effectiveness of situational leadership would be diminished and the use of this model for leadership could result in more problems rather than effectiveness. This is consistent with what was mentioned in the theories regarding the effective use of situational leadership styles such as the situational leadership II model. For situational leadership model II to be effective, leaders have to be able change their leadership style, in terms of supporting and directing, to match the level of experience of the group members they are leading (eds Muenjohn, Boucher & Tran 2010). A failure to do so would bring about an effective leader that would hinder the development of their group members or followers and indirectly affect the development of the organization as a whole (Blanchard 2010). Based on this, it can be seen that the findings that I have made regarding leadership styles such as participative leadership style and situational leadership is similar to what is taught in the theories in the course. In the process of conducting this research, I have learnt that many of the leadership styles are useful but they have flaws as well. Most leadership styles are effective if used at the correct time. However, if a leadership style is used inappropriately, it may bring about more problems and lead to leadership ineffectiveness. For instance, from this research, I have learnt that the use of participative leadership style in decision making is effective in helping the group makes a decision that is based on consensus of everyone. However, the use of participative leadership style in decision making may become ineffective when a decision has to be made quickly. One of the flaws of a participative style of leadership in the decision making process is that it often requires too much time before a consensus on the decision is made (eds Muenjohn, Boucher & Tran 2010). Other than the use of participative leadership style, the use of contingency approach of leadership styles would also lead to ineffectiveness if leaders use the wrong contingency leadership style for the wrong situation. For example, situational leadership II requires leaders to use appropriate leadership styles that can be more supportive or directive based on the level of competency and experience of the group members (Hellriegel & Slocum 2007). Based on situational leadership II, an effective leader would adopt a leadership style that is more directive and supportive when leading group members who are inexperienced. However, if a leader uses a leadership style that is less directive and supportive instead of one that is more directive and supportive, it may bring about ineffectiveness among the group due to ineffective leadership. In the process of conducting this research, I have understood that leading a group of people effectively is not a simple task. In order to be an effective leader, an individual has to learn how to effectively manage the group of people he is assigned to lead. In organisations, members of the organisations tend to have varying characteristics, working style, behaviour and experiences. Leaders would probably have to lead groups of people with varying characteristics or work with different groups of people throughout their lives. In order to be an effective leader, a leader has to be able to switch their leadership style to one that matches the people or situation they are leading in order to be effective. To be able to lead groups effectively regardless of situation, flexibility in a leader is required. According to Gamage (2006), effective leaders are usually flexible, allowing them to alter their leadership styles to one that is most appropriate and effective in whatever situation they are in. This means that for a leader to be able to use the contingency approach to leadership and be effective, flexibility is essential. Personally, other than the time I was serving National Service as a sergeant, I did not really have many opportunities to take on a leadership role. Hence, from this research, I have gained many insights that would be extremely useful for my leadership practice in the future. The importance of flexibility is one of the key takeaways from this research. During the time that I was serving National Service, I tend to use the same leadership style to lead my soldiers regardless of situation as I believed that it was the most appropriate and suitable leadership style for me. However, through this assignment, I learnt that there are many leadership styles that are effective and that a leader should be flexible to change their leadership style to one that best fits the situation in order to become an effective leader. Reddin (1970, cited in Gamage 2006, pp. 102) mentioned that the effectiveness of leadership styles depends on the situation. This means that leadership styles can either be effective or ineffective based on the situation in which they are used. If a leadership style is used in the wrong situation, it would be ineffective. However, if the same leadership style were to be used in an appropriate situation, it would be seen as an effective leadership style. What is important is that the leader needs to know which leadership style is appropriate for whatever situation they are given. From this, I have learnt that flexibility is an important trait that leaders should possess or develop and developing flexibility would allow me to be able to use the contingency approach of leadership styles better. Other than flexibility, another key takeaway that I have obtained from this research that would help me in my future leadership role was the understanding of using a contingency approach of leadership which requires me to select the correct leadership style for whichever situation in order to be an effective leader. Based on the theories taught in this course and the results of this research, I have come to an understanding that there are no ineffective leadership styles. All leadership styles are effective and the only reason why some people view certain leadership styles as ineffective is because they fail to match the correct leadership style to the situation (eds Muenjohn, Boucher & Trans 2007). From this, I learnt that there is no such thing as ineffective leadership style and that I should focus on matching leadership styles to situations in order to be an effective leader in the future. Conclusion In conclusion I believe that in order to be an effective leader, one must be able to understand the complexities of leading and how to handle these complexities. The leadership theories taught in this course and the insights gained from conducting this research has allowed me to gain a better understanding of some of these complexities of leadership. Some of the key takeaways that I have gained from this research were the importance of flexibility in a leader and the use of contingency approach to leadership style especially the situational leadership II model. The theories in this course have provided me with a basic understanding on leadership and through conducting this research, it further reinforced what I have learnt and understood from the course by allowing me to observe the application of some of the leadership theories. Through the observations and interview, I have learnt about various complexities of some of the leadership theories such as using a participative leadership style in the decision making process and the use of situational leadership II model. I believe that this understanding and knowledge that I have attained would greatly benefit me in my future endeavours as a leader. I thought, why should I pay $3 for a cup of coffee when I can buy it for $0.50 in Dunkin Donuts I thought it was absurd that a person should do that. My first Starbucks experience has been very memorable. Truly, it is incomparable with McCafe or Dunkin Donuts. Upon entry, the barista immediately greeted us and offered the menu. I was really impressed because she did not only manage to get my name but she asked me how I am, and suggest their specialty noting that I am a newcomer to the store. I noticed that she greeted my friend with her first name because she already is a regular customer. She even noted what my friend's favorite offering it to her even before she asks for it. In contrast to the cluttered space inside fast foods and bake shops, Starbucks offers a relaxing, inviting, and even calming ambiance. There were huge couches which look and feel like home. The music played was soothing yet at the same time invigorating. I felt so away from the demands and pressures of being a student. Because of these, I associate Starbucks with relaxation, socialization, and indulgence. Their stores become a haven where I not only indulge in a steaming or cold cup of specialty coffee made from organically grown coffee. Starbucks also offers a place where I can sit back and socialize with friends while also relaxing with my favorite songs. The good thing is, I can also take the coffee home and enjoy it while watching movies or just hanging around at school. From its humble beginning, Starbucks has risen to become the most profitable and popular coffee shops in the world. I believe that the company's success lies in its ability to fulfill its promises to the customers. Since its foundation, Starbucks focused in providing a third place where customers can linger the first two being work and home. The company has long envisioned creating a place where customers can unwind and socialize over a cup of coffee. The company complements all these through the provision of excellent customer service where baristas are encouraged to offer personalize service to each of the customer they encounter every day. Starbucks promises that in every moment spent at its stores, it will do everything in order to adequately provide what it calls the "Starbucks experience." Looking at it more closely, Starbucks influenced me a lot as a customer. For one, I never settle for anything less than it. First World War Essay I have focussed my monologue on the character of Sheila Birling. Her role in the play was significant as it is coming from the point of view of a young, upper class woman. Her naà ¯Ã‚ ¿Ã‚ ½ve views represent her role as an authoritative figure in society who has the ability to help Eva Smith, but her selfishness and her egotistic manner contradicts the main theme running through out the play of An Inspector Calls that one persons actions impact anothers and we all have a duty in helping people lower in the system. Sheilas main role in the play was that she was able and had the power to get Eva sacked because of her position in society, whereas Eva, who was of a lower class than Sheila, was not able to stand up for herself because she did not have enough power. Sheila abuses her superior position in society for petty reasons of that Eva is prettier than her.  I chose to write about her, as she is a very expendable character who has no firm reason or purpose in firing Eva Smith. When the inspector questions Sheila about the photo Sheila says You Knew it was me all the time, didnt you? By saying this Sheila opens herself up (explain) and seems to accept responsibility for her actions and is showing this to the inspector, rather than trying to cover the truth up with lies, or try to pass on the blame to others as some characters in the play do. Her character I think is important in the play, as I believe that Priestly was trying to demonstrate later on in the play that the youth could change. The setting of my monologue of Sheila alone and isolated symbolises her distance from what she was once in the play. The year now being 1916, four years down the line, she has turned her back on the aristocratic life and is trying to dissolve into an unprivileged life.  Her clothes are the colour of green and brown that shake off her previous character of wealth and affluence as to her new attempted classless status. Sheila has disconnected herself from the Birlings and perhaps is trying to punish herself by living the life that the Eva Smith once led. Sheilas job now includes working at homeless shelters and working for charities. Her language has become less energetic and fluent than it once was. I have however tried to include some of the phrases from the play it was a mean thing to do I tried to make use of punctuation and grammar to create her feelings and emotions. In the monologue I have use ellipsis to show pauses, when she might be thinking or reflecting on painful memories. Exclamation marks are used to get her point across that she is getting agitated and snappy To the audience, I was trying to convey the ideas of Sheila being a changed woman. That she has come to realise that status and power isnt everything. She can look past this now and look forward to a happy future with her new baby and Gerald, her husband.  I think the Play writers view on Sheila and all the characters from the play was that the younger generation can learn from their mistakes, and he directs strong criticism towards businessmen who are only interesting in making money and will never lean from their mistakes. Sheilas the second person to be questioned by the Inspector and her response to Evas death is the most caring and heartfelt. She is genuinely upset by the death of Eva. The play is set in 1912. The periods between 1910 and 1945 were a great period of social change. In 1912 was the year that the titanic set sail, the year that the Suffragette movement started campaigning for womens rights in society. The war being a main factor, affecting society greatly and it began the process of merging class boundaries. The upper class young men were sent to the front line as officers and where many of the great landed families of Edwardian Great Britain began to disappear. My overall intention with this monologue was to understand the significant character of the young, impressionable Sheila Birling and how she is central to the key themes in the play and how the Inspector plays the social conscience on all the characters minds.  By the close of the play, Sheila has come to realise that herself and her family have lied to each other, and also to the Inspector. She begins to see her whole life was a lie, the relationship she had with Gerald and lying to herself. She begins to see that she needs to start her life again with truth, starting with correcting her mistakes.

Cutaneous Leishmaniasis And Pathogenesis Biology Essay Leishmaniasis is a tropical, protozoan disease caused exclusively by intracellular parasites belonging to the genus Leishmania. Leishmaniasis is a worldwide problem and due to the various species of Leishmania, can manifest in humans as 3 main clinical forms: Cutaneous Leishmaniasis, Mucocutaneous Leishmaniasis, or Visceral Leishmaniasis. Consequently, the severity of the infection and symptoms differ from self healing infections that produce significant scars to the fatal infections. Pathogenesis Leishmaniasis is transmitted by the bite of female insect vector sand flies of the species Phlebotomus in the Old World and Luzomyia in the New World (Figure 1). The life cycle for all Leishmania species is relatively simple and similar (Figure 2). When the sand fly takes a blood meal, it inoculates the source with the 2-3 mm long parasite. At this stage, the Leishmania parasite is known as a promastigote as it contains a singular flagellum. Promastigotes are injected into the host skin, after which they attach themselves to the hosts macrophages, and are induced by phagocytosis. These white blood cells are present at the inoculation site because of the hosts natural immune response to the sand fly bite. Once inside the macrophages, the promastigotes transform into their non-flagellate form, known as amastigotes. From here the amastigotes reproduce by binary fission and continue to proliferate within the white blood cells until the cell bursts. The parasites are then free to infect and invade other reticulo-endothelial cells, which share the same fate and are destroyed due to the reproduction of amastigotes within. The amastigotes and infected macrophages enter the blood circulation. The life cycle of Leishmania is continued when a female sand fly feeds on the infected hosts blood and the amastigotes are taken up by the sand flies. Amastigotes transform into promastigotes, which proliferate by binary fission in the midgut of the sand fly over a period of 4-25 days (WHO, 2010). Hereafter, the promastigotes migrate to the fly proboscis or mouthparts, where the parasite can infect a new host during feeding (Murray et al, 2009) and thus the Leishmania lifecycle is continued. Mammals are more often reservoirs for infection. As well as humans; dogs, rodents, wolves and foxes are examples of common reservoirs (Neuber, 2008) and thus, can suffer from leishmaniasis diseases too. Figure 2: The life cycle of Leishmania. Epidemiology Leishmaniasis is endemic in 88 countries, 72 of which are developing countries. An estimated 12 million people are infected with leishmaniasis and 70,000 people die each year (Reithinger et al, 2007). There are currently about 350 million people worldwide that are at risk and threatened by leishmaniasis because they live within 40Â ° north and south of the equator (Jones et al., 2005; Neuber, 2008) and according to the World Health Organisation (2010), there are an estimated 1-2 million new cases each year. There are approximately 20 species of Leishmania which are pathogenic for humans (Chappuis et al., 2007). These species vary in their geographical location and have an effect on the leishmaniasis which manifests (Table 1). Cutaneous leishmaniasis is the most common form of leishmaniasis and is endemic in over 70 countries worldwide (Figure 3). It is found throughout Africa and the Middle East in Afghanistan, Algeria, Iran, Iraq, Kabul, Pakistan, Saudi Arabia, Syria; however, more particularly in South America, in Brazil and Peru (Reithinger et al, 2007; Murray et al, 2009). Over 90% mucocutaneous leishmaniasis often occurs in Bolivia, Brazil and Peru and the majority (over 90%) of visceral leishmaniasis cases, the most dangerous form, is localised to 6 countries; Bangladesh, Brazil, Ethiopia, India, Nepal and Sudan. Clinical Presentation Cutaneous Leishmaniasis Cutaneous leishmaniasis is a localised reaction at the inoculation site, which tends to be uncovered areas such as the face, hands and lower legs. Between 2 weeks and 2 months after the sand flys bite, a red papule forms. The area begins to swell and become irritated and after 3-4 weeks, flat ulcers form which eventually harden and form crusted margins. The volcano-like lesions that form can heal without treatment; however, sufferers are commonly left with significant, disfiguring scars. Mucocutaneous Leishmaniasis Mucocutaneous leishmaniasis, also known as espundia, is most often caused by Leishmania viannia braziliensis and has a similar incubation time as cutaneous leishmaniasis. However, this form causes more devastating disfigurement to disease sufferers as the parasites metastasise towards to the mucosal membranes and destroy them and nearby unrelated tissue structures also (Murray et al, 2009). This form is more commonly seen after a primary infection of cutaneous leishmaniasis, where the lesions have eventually healed. Untreated lesions can transform into mucocutaneous forms and year later the oral and nasal mucosas become infected. Inflammation of the nose, mouth, oropharynx and trachea cause sever mutilation and facial disfigurement. Death can sometimes arise as mucosal lesions do not self-heal and prolonged infection compromises both immune and respiratory systems. Visceral Leishmaniasis Visceral leishmaniasis, also known as, kala-azar, dumdum fever or black fever, is the most severe form of leishmaniasis, and if left untreated, those infected will die. It is the most dangerous because parasites leave the skin and colonise the entire reticulo-endothelial system (Neuber, 2008) and spread to internal organs. Incubation period may be from several weeks to a year and can present as a rapidly fatal disease or as an asymptomatic, self-limiting infection (Murray et al, 2009). As the parasites proliferate and destroy the hosts cells, sufferers present with a marked enlargement of the liver, spleen lymph nodes as well as fatigue, weight loss, fever chills, severe anaemia and kidney damage. Death is caused by haemorrhage, complications relating to anaemia or a weakened immune system which cannot deal with bacterial co-infections (Chappuis et al, 2007). As is the case with all forms of leishmaniasis, the chances of the sufferer developing a secondary infection, such as a bacterial infection, are very high and doing so, can complicate the disease further and may lead to death. To add: one photo for each CL, ML and VL. Canine Leishmaniasis Leishmania infantum not only cause severe disease in humans, but in dogs also. Millions of dogs in Europe, Asia, North Africa, and South America are affected by the parasite. There are some clinical manifestations of the disease in dogs which re similar to that of humans including cutaneous alterations, enlargement of lymph nodes, liver and spleen, weight loss and glomerulopathy. As well as this, ocular lesions, epistaxis (nose bleeds), onycogryphosis (abnormal curving of claws) and lameness (disability in walking) are classic symptoms found in infected dogs (Maia and Campino, 2008). As with visceral leishmaniasis, canine leishmaniasis may also present as an asymptomatic infection, thus delaying necessary treatment. Diagnosis Due to the clinical presentations of the disease, a diagnosis can be made; however, for a definitive diagnosis the Leishmania parasite must be detected to confirm the diagnosis. Parasitological techniques are routinely used and involve demonstrating promastigotes in a direct examination of tissue aspirates, or detecting amastigotes in biopsy specimens, which are then, examined using a microscope. Serological techniques to diagnose leishmaniasis are based upon indirectly identifying specific host humoural and cell-mediated responses after inoculation of the parasite. Diagnostic methods include direct agglutination test (DAT), the immunofluorescence antibody test (IFAT), the enzyme-linked immunosorbent assay (ELISA), immunoblotting and antigen detection. Molecular techniques involve detecting leishmanial DNA or RNA have been beneficial in not only diagnosis, but species identification also. The molecular techniques include using various versions of polymerase chain reactions (PCR) to amplify species specific parasite sequences, DNA probes, monoclonal antibodies (MAbs) and isoenzyme electrophoresis. Treatment All forms of leishmaniasis should be treated due to their mortality and morbidity consequences. Drugs are available to treat the disease and choice for all forms is the pentavalent antimonial compound sodium stibogluconate (Pentostam). Cutaneous leishmaniasis is also treated with injections of other antimonial compounds, such as fluconazole and litefosine, directly into the infected lesions (* Figure). Miltefosine has also proven to be an effective treatment for visceral leishmaniasis (Murray et al, 2009). However, as with all drug treatments, the development of drug resistance is a huge issue and over use of this drug in previous years could lead to Leishmania species becoming resistant. As well as this, there are considerable side effects associated with most drugs (Neuber, 2008). A safe and effective vaccine against the various species is urgently required particularly in endemic areas; however, there is currently no vaccine available although work to develop one is still ongoing. (To add: * Figure of such treatment) Social and Economical Implications Leishmaniasis is found in developing countries or the poorer regions of a country and thus commonly affects the poorest of the poor. Having such a disease can cause many problems in the lives of those infected and their families as they become poorer due to the direct and high costs of diagnosis and treatment of the disease, and the indirect costs such as loss of income (Chappuis et al, 2007). Another impact of the disease is the social and psychological stigma associated with leishmaniasis, because of the disfigurement and significant scarring caused. Thus, even after the disease has been treated or self-healed, patients must deal with a constant reminder of what they had to endure. Cheap, rapid and accurate diagnostic methods are needed to allow all those infected, especially the poor, to get the medical attention they need, and to also allow treatment to start as soon as possible thus ensuring symptoms may not be as detrimental. Project Aims The aim of this project is to compare the different methods for diagnosis of leishmaniasis in humans and dogs. These methods will be critically analysed in order to test the following hypothesis: A Leishmania infection can be detected unequivocally. In doing so, the necessary requirements for a correct diagnosis for those who live in endemic areas and for those whom leishmaniasis is a threat, will also be discussed.

Everyone has seen the horror movie narrative time and time again. One person watches someone they love be put into a horrifying circumstance while being nothing but a helpless bystander, watching through a window or a television screen. Watching the bystander is almost as tragic as watching the victim, as the innate compulsion of a human to help others is relatable and recognizable to everyone. Unfortunately, there is a community in today’s world that is prevented from helping fellow humans in a simple act of charity some may take for granted: giving blood. Current United States policy bans homosexual men from being blood donors, regardless of testing and other standard procedures, such as testing blood for transmittable diseases and administering extensive questionnaires regarding risk factors of blood-borne illnesses (American Red Cross, 2012). This policy preventing men who have sex with other men (MSM) from donating blood should be modified, as advancements in technology h ave eliminated the high safety concern that once made the policy the best logical solution for safe blood transfusion (US Department of Health and Human Services, 2009). Policies restricting blood donors cover a wide range of potential issues with the blood supply. For the most part, these policies are very logical and give a greater piece of mind to those receiving blood; however, the policy regarding homosexual men is both outdated and illogical. Today, more and more colleges are offering courses to students that are entirely online. Students who are drawn to online courses include students working full-time jobs, students who would prefer a private study environment, or students who find that online courses are easier than traditional (campus-based) courses. Advertisements geared to encourage students to register for online classes have the tendency to portray them as being easier and requiring less work than its campus counterpart. For instance, some television advertisements show students wearing night clothes working in a relaxed environment within their home - free of the pressures caused by deadlines and testing. Despite the fact that online courses and traditional courses generally cover the same material on a given subject—the two are markedly different with regards to technical requirements, social interaction, testing, and practice. Possessing strong computer skills is one of the fundamental requirements for a student taking an online course. In contrast, traditional courses seldom require the use of computers; instead, online courses are conducted entirely on a computer via the internet. Students must know how to navigate the internet, use email to communicate and submit assignments, and use word processing and other programs required for the specific course. Students who are novice computer users will be at a great disadvantage and likely will not complete the course with a satisfactory grade. Students who possess these skills will be able to excel through online courses with greater ease, and more flexibility than courses taught on campus. Ghosts and apparitions really took over MacBeth’s emotions and fears. For example in the opening scene witches are used   to create an atmosphere of horror and suspense. Later in the scene   the ghost of Banquo appears at the dinner table and drives Macbeth mad. His wife try's to calm him but she can't and Macbeth has the people at the table getting awfully suspicious. Again we see it when Macbeth saw the dagger, he is seeing things due to guilt. The witches foresaw what happened through the play by telling Macbeth his future as well as Banquo. Ghosts made the audience feel scared the sky black and the wind misty. Witches in the play did prophecise to Macbeth that he would be king. Macbeth knowing this information became curious, knowing that Duncan was king he wondered how he would acheive the position. So he did indeed kill Duncan under the guidance of the three witches. The witches in this play in terms of ghosts are concerned,   we see they are not human or half ways normal when baquo quotes to Macbeth that are not human like as well as   irregular in some sort and very unattractive. This leaves a feeling of darkness for example the sky is black and the grass is gray instead of green the branches on the tress are short and rotting. The witches were Macbeth’s fortune tellers but they lead him a bad life In the end. Ghosts and apparitions not only drove Macbeth to his grave but also gave him up. When he kills Duncan there is a sense of real guilt. We see him going crazy   and feeling extreme guilt when immediately after he kills him he sais to his wife what a sorry sight and she tells him to stop worrying about Duncan and to get on with his life. She also tells him to stop being a coward, and that killing was the only option. In actuality it is not because a murder will never stay secret. Ghosts were a big factor in this play but guilt plays a part as well, a much bigger part. Guilt led to the witnessing   of ghosts. For example when Macbeth hosts   the dinner he witnesses baquo’s ghost this has an   affect of pity for Macbeth as far as the audience is concerned, Macbeth himself from guilt is going crazy.

CHAPTER EIGHT MISREPRESENTATION A misrepresentation is an untrue statement, which induces the other party to enter into the contract. A misrepresentation may be fraudulent, negligent misstatement, or wholly innocent. The applicable remedy depends on the nature of the misrepresentation. In order for a representation to amount to an actionable misrepresentation it must be: a)false; b)one of fact as oppose to intention, opinion, or law; c)The statement must be addressed to the party who claims to have been misled; )it must be the chief reason which induced the other party to enter the contract. If the representation that is being challenged satisfies these four requirements, then it is an actionable representation. Statement of Fact or Opinion A statement which is made to the other party that is false and induces him to enter into the contract, this is an actionable misrepresentation. The false statement must be one of fact and not of law because no one can misrepresent the law since ev eryone is presumed to know the law.A statement of opinion is not actionable per se as a misrepresentation because it is not a statement of fact. In Bisset v. Wilkinson, the respondent purchased from the appellant, two plots of land in New Zealand for the purpose of sheep farming. During the negotiations, the appellant told the respondent that, if the place was worked properly, it would carry two thousand sheep. The respondent, it was admitted, bought the place believing that it would carry two thousand sheep.As both parties were aware, the appellant had not and, so far as appeared, no other person had at anytime carried on sheep farming on the land. In an action for rescission for misrepresentation, Sim J. said: In ordinary circumstances, any statement made by any owner who has been occupying his own farm, as to its carrying capacity would be regarded as a statement of fact†¦. This, however, is not such a case †¦ in these circumstances. The plaintiff were not justified in regarding anything said by the defendant as to the carrying capacity as being anything more than an expression of opinion on the subject.Their Lordships concurred in their view on the matter, and therefore held that the purchaser had no right to rescind the contract since an erroneous opinion stated by the party affirming the contract, though it has been relied upon and has induced the contract on the part of the party who seeks rescission, gives no title to relief unless fraud is established. The ratio decindendi of this decision is that the respondent had no previous or present knowledge of the capacity of the land, neither was he an expert in sheep farmingSo in the opinion of the Court the most he could have averred was a mere opinion. However, in certain circumstances, an opinion because it presupposes the possession of certain knowledge, may be an actionable misrepresentation. In Smith v Land and House Property Corporation, the vendor of an hotelier described it as let to a Mr. Frederick Fleck, a most desirable tenant. The tenant was in fact in arrears with his rent. It was held that the statement was not a mere expression of opinion because the vendor was impliedly stating that he has facts, which justifies his opinion.The court deemed the vendor to have knowledge of particular facts; therefore the ‘opinion’ was regarded as a misrepresentation of fact, which induced the other party to enter into the contract. The decision in Bisset’s case was followed in Esso Petroleum Co. Ltd. v. Mardon. Esso’s experienced representative told Mardon that Esso estimated the through-put of petrol on a certain site would reach 200,000 gallons in the third year of operation, and so persuaded Mardon to enter into a tenancy agreement in April 1963 for three years.Mardon did all that could be expected of him as tenant but the site was not good enough to achieve a through-put of more than 10,000 gallons. In July 1964 Mardon gave notice to quit, but Es so granted him a new tenancy at a reduced rent. Mardon continued to lose money and by August 1966 was unable to pay for petrol supplied. Esso claimed possession of the site and the money due. Mardon claimed damages in respect of the representation alleging that it amounted to 1) a warranty, 2) a negligent misrepresentation. On the matter Lord Denning M. R. said that Council for Esso retaliated by citing Bisset v. Wilkinson where the Privy Council said that a statement by a New Zealand farmer that an acre of land† would carry 2000 sheep was only an expression of opinion. He submitted that the forecast here of 200,000 gallons was an expression of opinion and not a statement of fact, and that it could not be interpreted as a warranty or promise. Lord Denning said that he would quite agree with Counsel for Esso that it was not a warranty – in this sense that it did not guarantee that the through-put would be 200,000 gallons.But one party, Esso, has special knowledge and ski ll. It was the yardstick by which they measure the worth of a filling station. They knew the facts. They knew the traffic in the town, they knew the through-put of comparable stations. They had much experience and expertise at their disposal. His Lordship went on to show that Esso was in a much better position than Mr. Mardon and their statement of opinion presupposes that they have knowledge to support the opinion. This is very different to the circumstances in Bisset v.Wilkinson where the land had never been used as a sheep farm and both parties were equally able to form an opinion as to its carrying capacity. The Court, therefore, found that Esso was liable for damages for breach of warranty. Fact and Intention Where a representation merely expresses the intention of one party, under normal circumstances the intention, if it is not fulfilled, is not an actionable representation. However, in some circumstances an expression of intention may be considered a statement of fact. In Ed gington v.Fitzmaurice, Bowen LJ said: â€Å"There must be a misstatement of an existing fact: but the state of a man’s mind is as much a fact as the state of his digestion. † The facts in that case are: The directors of a company invited a loan from the Public and stated that the money would be used to improve the company’s building and to extend the business. The real intention of the directors was to use the money to pay off the company’s existing debts. Their statement of intention was held to be a statement of fact. Can Silence Amount to Misrepresentation?Generally silence is not misrepresentation. Each man must protect his own interest and exercise reasonable caution when entering a contract: Caveat emptor. However, the court may consider certain kinds of silence as misrepresentation. In With v O’Flanagon the defendant wanted to sell his medical practice. The negotiations began January 1 at which time the practice was worth ? 2000. 00 per year . However, the defendant fell ill and by May 1 when the contract of sale was signed, the practice was virtually worthless.It was held that the defendant’s silence in the situation amounted to a misrepresentation. Opportunity to Verify Representation Where the representee is given the opportunity to verify the representation made to him, he may or may not make use of the opportunity. If he chooses to act on the statements made by the representor and the statements turn out to be false he can sue but if he chooses to verify and confirm a statement, which is in fact false, he cannot sue the representor. In Redgrave v. Herd, a man was induced to buy a solicitor’s practice by a misstatement of its value.He was given the opportunity to inspect the books, but he did not. If he had checked the books, he would have found that the practice was over-valued. However, the Court held that the non-use of this opportunity did not vitiate his claim. The Privy Council in Senanayake v. C henq followed this decision. However, when the representee carries out independent investigation to ascertain the accuracy of any statement made to him, though he did not find out the truth, he cannot claim to have been misled because then he would be relying on his own findings or that of his experts.In Atwood v. Small, a vendor offered to sell a mine and made exaggerated claims as to its capacity. The buyer appointed agents to investigate the mines. The agents reported wrongly that the claims were true. The contract of sale was then completed. It was held by the House of Lords that, the buyer’s subsequent action must fail because they have not relied on the vendor’s statement, but on their own independent investigations. Curtis v. Chemical Cleaners misrepresentation. Types of MisrepresentationFraudulent Misrepresentation. Fraud was defined by Lord Herschel in Derry v. Peek as meaning that the representation made is a false representation: 1) Knowingly or 2) Without b elief in its truth or 3) Recklessly, careless whether it is true or false. Fraud must be strictly proven and the burden of proof is high: It requires evidence of actual dishonesty. Negligent Misrepresentation/misstatement. Liability in damages for negligent misrepresentation was created by the decision in Hedley Byrne & Co Ltd. v.Heller & Partner, if there is a special relationship and that the defendant was a skilled professional person acting in the course of his business upon whose advice it is reasonable for the plaintiff to rely. Section 2(1) of the Misrepresentation Ac, 1967, codified this principle. The defendant can escape liability on the section if he can show that he had reasonable grounds for the belief and that he held those beliefs up to the time the contract was made that the facts represented were true. The burden of proof is on the representor.See the judgment of Lord Denning in Esso Petroleum v. Mardon. Seeing that the S. 2 (1) supersedes the Hedley Byrne’s case, it is doubtful whether this additional head of damages would add anything to the existing rights under S. (1). Where a representation becomes a term of the contract, the plaintiff will sue for breach of a contractual term or breach of warranty, not for misrepresentation. Innocent Misrepresentation. Whittington v. Seale-Hayne Types of Remedies An actionable misrepresentation attracts the remedies of rescission and damages.Rescission, providing that none of the bars to rescission are applicable, cancels the contract and restores the parties to the status quo ante. When rescission fails the innocent party will be awarded damages which is a monetary compensation that will put him in the position he would have been in but for the misrepresentation of the representor with whom the innocent party had contracted. Rescission or Cancellation. The right to rescind is the right of a party to have the contract set aside and to be restored to his former position. The contract remains valid unless and until rescinded.Third parties may acquire interest under the contract if the innocent party does not act with promptitude, providing that the innocent party is a bona fide(honest) purchaser for valuable consideration. In Car & Universal Finance v Caldwell, the defendant sold his car on January 12, 1960, to Norris who took it away leaving a deposit of ? 10 and a cheque for ? 965. The cheque was dishonoured when the defendant presented it the following day. He immediately informed the police and the Automobile Association of the fraudulent transaction.Norris subsequently sold the car to a third party who sold it to the plaintiff. The question the Court had to decide was whether the defendant’s conduct and representations on or about January 13 amounted to a rescission of the contract of sale. Lord Denning M. R. held that where a seller of goods had a right to avoid a contract for fraud, he sufficiently exercised his election if, on discovering the fraud, he immediate ly took all possible steps to regain the goods, even though he could not find the purchaser or communicate with him, and the contract was rescinded on January 13.If the innocent party delayed cancelling the contract, any third party who purchased the item bona fide would have acquired a good title to the property and the original owner had no claim to it. See the speech of Lord Wilberforce in Johnson v. Agnew. There are several bars to the right to rescind which may work against the innocent party to the contract. The bars are restitution impossible, third-party rights, affirmation, lapse of time. These are discussed in the paragraphs that follow. Restitution Impossible.When a party rescinds a contract, it must be possible for the Court to restore the two parties to the Status quo ante, to put the parties back in their original position before the contract was made. However, this limitation should not be strictly construed, and the mere fact that the subject matter of the contract m ay have deteriorated before the truth is discovered, is not sufficient to prevent restoration and so destroy the right to rescind a contract. * In Newbigging v. Adam, rescission was granted even though the partnership business was worse than â€Å"worthless†.The facts of that case were â€Å"The plaintiff entered into an agreement with the defendants by which he was admitted as a partner with a manufacturing business and provided ? 10,000 of new capital. He was induced to enter into the agreement by a material innocent misrepresentation as to the capacity of certain machinery. The business failed, and the plaintiff sued for rescission of the agreement for recovery of his capital, and for an indemnity against all claims which might be made against him by virtue of his being a partner.The Court unanimously agreed that he was entitled to the remedy for which he asked. Before the passing of the 1967 Misrepresentation Act, there was a further bar of rescission: if the misrepresen tation was innocent, there could be no rescission of a contract after it has been executed. * Seddon v North East Salt Co. Ltd. The extent of this rule was somewhat uncertain and it was the subject of much discussion, for in many cases the falsity of the misrepresentation cannot be discovered until the contract is executed. However, the Privy Council in Senanayake v. Cheng did not follow the decision. By S. (2), except in the case of fraud, of the 1967 Misrepresentation Act, the Court has a discretion to allow rescission and to award damages in lieu of rescission, and in this way could allow the contract to continue to subsists whether it was executed or not. The act has over rule Seddon’s case, Wilde v. Gibson. * Third-party Rights. As stated above a third party may acquire a good title if the owner of the property did not act speedily to rescind the contract, providing that the third-party has no knowledge of the origin of the property and could not reasonably be expected t o: Car & Universal Finance v.Caldwell. A similar decision was made in Lewis v. Averay: The plaintiff advertised his car for sale. A rogue, posing as the well-known television actor, Richard Greene, called on the plaintiff and offered to buy the car. The plaintiff accepted the order, and the rogue wrote out a cheque, signed it, â€Å"R. A. Greene’. The rogue wished to take away the car at once, but the plaintiff was not willing for him to have it until the cheque had been cleared. At the plaintiff’s request the rogue produced identification that he was R.A Greene in the form of a special pass of admission to Pinewood Studios, bearing the name R. A. Greene’ and an address, a photograph of the rogue, and an official stamp. The plaintiff was satisfied on seeing this pass and allowed the rogue to have the car. The cheque was worthless and the rogue sold the car to the defendant, a music student, who bought is in good faith. The Court of Appeal held the plaintiff int ended to contract with the person before him. The contract was merely voidable for fraud and the defendant, a third party, acquired a good title in the car against the plaintiff.Affirmation of the Contract. If after becoming aware of the misrepresentation the party affirms the contract either by express words or by taking any benefit under the contract, e. g. accepting dividends on shares, or failure to remove his name from the register of shareholders. In Long v. Lloyd the plaintiff was induced to purchase a lorry by the defendant’s representation that it was â€Å"in excellent condition†. On the first journey after the sale, the dynamo broke and the plaintiff noticed several other serious defects.The defendant was informed of these and offered to pay half the cost for the repairs. On the next long journey, the lorry broke down completely and the plaintiff realised that it was in a deplorable condition. He claimed to rescind the contract. The Court held that the secon d journey amounted to an affirmation and therefore the right to rescind was lost. Lapse of Time Under certain circumstances, lapse of time may be deemed to be affirmation, especially if the other party takes a considerably long time to rescind the agreement.However, normally, time does not beginning to run until the plaintiff becomes aware of the misrepresentation. In Leaf v. International Galleries, the plaintiff bought from the defendant a painting of Salisbury Cathedral which the defendant innocently represented to him at the time of the purchase to have been painted by Constable. Five years later, when he tried to sell it, he discovered that was not the case. He brought an action for the rescission of the sale. The Court of appeal held that it was too late to rescind the contract.Damages The remedy of damages, availability or otherwise depends on the nature of the misrepresentation committed fraudulent, innocent, or negligent. In Newbigging v. Adam damages were award for misrepr esentation. In Whittington v. Seale-Hayne, the Court granted the plaintiff an indemnity against some of the lost which he suffered due to innocent misrepresentation. In Hussey v.
